The Creation of a Conservative Super-Majority
Following Donald Trump’s election, a solid Supreme Court majority in favor of some protection for abortion access was rapidly replaced by the most conservative justices nominated in nearly a century. Trump’s three nominees, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett, belonged to the right-leaning Federalist Society and took opposition to Roe as an article of faith. As important, the new justices no longer seemed constrained by concerns about the Supreme Court’s legitimacy. Even as approval of the Court plummeted to historic lows, the justices rushed to undo abortion rights.
