Did you know that a birth certificate isn't enough legal protection even when both parents are listed on it?
For this reason, @missyhalle and her wife hired an attorney who filed a "Petition to Establish Parentage" to obtain a court order which will establish full legal rights for both parents.
A birth certificate is an administrative document, not a court order. Though the U.S. Supreme Court legalized gay marriage in 2015, the Court DID NOT rule that states must also recognize the legal rights of LGBTQ+ parents.
"As someone with a parent who is unsupportive and who would certainly fight Kim for custody of Breslyn if something happened to me, that is a scary thought," says Melissa. "For this reason, we hired an attorney who filed a 'Petition to Establish Parentage' to obtain a court order which will establish full legal rights for both Kim and me."
"I strongly recommend that same-sex couples obtain a court order for the "other" (non-biological or non-adoptive) parent," says Melissa. Yes, even if you're married and even if you're both on the birth certificate.
"With women’s civil rights being overturned and other legal protections being challenged in our country, protecting our families has never been more important!"
