AI artworks are hot right now. But a recent US Federal Court ruling suggests creatives producing solely AI-driven projects won’t be able to patent their work. The ruling responds to computer scientist Stephen Thaler’s ongoing legal battle to copyright the inventions of his AI software. Earlier this year, Thaler was denied copyright by The US Copyright Office on an artwork produced by his AI system, Creativity Machine – a request he initially filed in 2018. The new ruling from the US Federal Court is in line with this decision, concluding “that the Patent Act requires an ‘inventor’ to be a natural person”, i.e. a human being.
