We wanted our journey to parenthood to include a sense of reproductive freedom and legal protection. For us that meant exercising our right to try to create a baby at home, without a doctor’s direction or intervention. When procreation outside of a traditional marriage was socially unacceptable, and to many a sin, doctors became the legally-appointed gatekeepers regulating who, of those who were unable to conceive via sex, was “fit” to be a parent. This was mostly based on relationship status as a cis/hetero married couple. Many intended parents were turned away due to race, sexuality, IQ, ability, and socioeconomic status. Physicians of the 1970s acknowledged that the simplicity and ease of home insemination might also be the biggest hazard-- it could challenge traditional family structures and the legal rights attached to parents and the genetic material involved in conception. In 1985, a parenting book for lesbians was published that presumed conception would occur via home insemination. Yet as is common throughout history, social progress went far beyond what was addressed in law. At that time, performing “artificial” insemination without a medical license was a punishable offense (in GA a felony, in OR & ID a misdemeanor). As of 2015, 20 states still had laws requiring that a physician perform “artificial” insemination for the donor’s rights to be legally terminated.
